The aim of the present investigation was to describe and to classify significant ethical problems encountered by the members of the staff during the daily clinical work at a hospital medical department. A set of definitions was prepared for the purpose, including the definition of a 'significant ethical problem'. During a three month period 426 inpatients and 173 outpatients were admitted. Significant ethical problems were encountered during the management of 106 in-patients (25 per cent) and 9 out-patients (5 per cent). (...) No significant difference was found between the frequency of ethical problems in female and male patients, but a positive correlation was noted between the number of problems and the patients' age. The problem types were classified according to a problem list. The results of this investigation suggest that greater attention must be paid to discussions about ethical problems among doctors and other categories of health personnel and that, among others, medical students ought to be taught the analysis of ethical problems. We consider the influence that John Forrester’s work has had on thinking in, with, and from cases in multiple disciplines. Forrester’s essay ‘If p, Then What? Thinking in Cases’ was published in History of the Human Sciences in 1996 and transformed understandings of what a case was, and how case-based thinking worked in numerous human sciences (including, centrally, psychoanalysis). Forrester’s collection of essays Thinking in Cases was published posthumously, after his untimely death in 2015, and is the inspiration for the (...) special issue we introduce. This comprises new research from authors working in and across the history of science and medicine, gender and sexuality studies, philosophy of science, semiotics, film studies, literary studies and comparative literature, psychoanalytic studies, medical humanities, and sociology. This research addresses what it means to reason in cases in particular temporal, spatial, or genre-focused contexts; introduces new figures (e.g. Eugène Azam, C. S. Peirce, Michael Balint) into lineages of case-based reasoning; emphasizes the unfinished and unfinishable character of some case reading and autobiographical accounts; and shows the frequency with which certain kinds of reasoning attempted with cases fail (often in instructive ways). The special issue opens up new directions for thinking and working with cases and case-based reasoning in the humanities and human sciences. (shrink)

Two of the dominant frameworks for criticizing capitalism and liberal democracy in contemporary political theory is Socialist republicanism, on the one hand, and radical democracy, on other hand. Whereas radical democratic thinkers have for decades criticized liberal democracy for being elitist, hierarchical and outright anti-popular, socialist republicans have for the last 10 years developed critiques of capitalism centred on the neo-republican idea of freedom as non-domination and proposed various arguments for workplace democracy and cooperative forms of ownership. Despite the common (...) ambition of uncovering hierarchical relations of economic, political and social power, and creating new egalitarian and participatory modes of political organization, no systematic comparison of socialist republicanism and radical democracy exists. This paper fills this gap by comparing the different understandings of (a) institutions and (b) political action and (c) their diverging historical and political relations to socialism. (shrink)

This paper considers Cassius Dio's account of the early worship of Augustus. Its main focus is the number of cults consecrated to the worship of Rome's new undisputed leader and his father, the now deceased and deified Divus Iulius, after the triumvir, on his way back from Alexandria in 29 b.c.e., wintered in Asia Minor. In his account of how the first official worship of Augustus was organized, Dio describes how Augustus let two separate cults inaugurate: a joint cult to (...) the worship of Divus Iulius and the goddess Thea Roma—a Greek deity, which since the second century served as a personification of Roman rule or Roman power—and a personal cult to the worship of the victorious triumvir. To discover a unifying theory of biology, it is necessary first to believe in its existence and second to seek its elements. Such a theory would explain the regulation of the cell cycle, differentiation and the origin of life. Some elements of the theory may be obtained by considering both eukaryotic and prokaryotic cell cycles. These elements include cytoskeletal proteins, calcium, cyclins, protein kinase C, phosphorylation, transcriptional sensing, autocatalytic gene expression and the physical properties of lipids. Other more exotic candidate (...) elements include the dynamic enzoskeleton, ATP generation, mechanotransduction, the piezoelectric effect and resonance. Bringing these disparate elements together — and discovering others — will require extensive collaborations between specialists from different sciences. Nous chercherons tout d'abord à repérer et identifier les nouveaux territoires du droit en montrant comment la norme juridique contribue en permanence à réinventer le réel, à fabriquer inlassablement la condition humaine, à se présenter sans cesse comme l'instituteur du social. But the "good" in a good death is obviously open to interpretation. Good for whom? The individual? The family of the individual? The society? And, who decides? The individual? The doctor? The family of the individual? The legal system? These questions are constantly raised throughout the (...) literature with diametrically opposed answers given from the earliest times to the present. And, unfortunately, one word is used for all the positions, with two subcategories, voluntary and involuntary, both of which are perceived as good for someone.Death is universal but whether or not a person should have a choice about when to die or voluntary euthanasia is deeply controversial.1 Inducing such a death, primarily in cases of a painful terminal disease, appears to be largely a nineteenth-century invention while, of course, existing as a concept well before that.2 Also, discussions of voluntary euthanasia raise related issues, suicide, involuntary euthanasia, and how eugenics has determined the criteria for involuntary euthanasia. Also, the fear of someone [End Page 238] being putting to death for the convenience or advantage of the living has been the most prominent issue, and one must wonder if involuntary euthanasia, at least when consent was possible but not given, ever constitutes a "good" death. As simply a peaceful and painless death, the earliest use of the word was by Suetonius in the early first century, where in his life of Augustus he reports Augustus's position on death as that "on hearing that anyone had died swiftly and painlessly, he prayed that he and his might have a like euthanasia, for that was the term he was wont to use."3 In his De Augmentis Scientiarum [Advancement of Learning], Francis Bacon refers to this statement, commenting, "For it is no small fidelity which Augustus Caesar was wont so earnestly to pray for, that same Euthanasia … was not so much like death as like falling into a deep and pleasant sleep." And Bacon continued: "In our times the physicians make a kind of scruple and religion to stay with the patient after he is given up, whereas in my judgment, if they would be wanting in their office, and indeed to humanity, they ought to acquire the skill and to bestow the attention whereby the dying may pass more easily out of life. This part I call the inquiry concerning outward Euthanasia, or the easy dying of the body (to distinguish from that Euthanasia which regards the preparation of the soul)."4The most explicit statement, generally ignored for sixty years, was that made in an 1870 speech to the Birmingham Speculative Club by Samuel D. Williams Jr., about whom little is known. Williams proposed:That in all cases of hopeless and painful illness, it should be the recognized duty of the medical attendant, whenever so desired by the patient, to administer chloroform or such other anæsthetic as may by-and-bye supersede chloroform—as to destroy consciousness at once, and put the sufferer to a quick and painless death; all needful precautions being adopted to prevent any possible abuse of such duty; and means being taken to establish, beyond the possibility of doubt or question, that the remedy was applied at the express wish of the patient.5This was not, though, the usual practice and many doctors saw no need to act. At an early date this tradition was enlarged and strengthened by the infiltration into Muslim culture of Greek philosophy and science through the translation of Greek classics by Muslims. C.S. Lewis was a major public intellectual in Britain, beginning from the late 1930s and continuing to his death in 1963. In both his non-fiction, especially The Abolition of Man, and his fiction, most importantly in That Hideous Strength, he offers a critique of rationalism and scientism that is often strikingly similar to those that Michael Oakeshott penned in the late 1940s and early 1950s. This essay examines the question to what extent this similarity is merely superficial, and to what (...) extent the two writers shared a similar basis for their views. Furthermore, it examines whether there is an actual thread of influence: had Oakeshott been reading Lewis before writing his critique of rationalism, and if so, to what extent did Lewis’s work inform Oakeshott’s? This PhD responds to a two fold problem with the philosophy of design and the practice of design. The philosophical problem is stated as the discrepancy between a dominant philosophical framework that orders the world according to eternal essences and the actual conditions of the world in which we exist: the conditions of becoming and of flux. Commencing with a critique of the western metaphysical tradition of statics this research project proposes that we need to find a way of describing (...) an evolutionary model of practice, and by so doing to provide a revitalised narration of process. Consequently, the PhD explores the meanings of process through a critical examination of an ensemble of projects created by the author. Within this framework, a number of questions are posed in order to explore the proposition of a process practice. These questions are: What is process? How does one think process? Indeed, how do we get to grasp change? What are the consequences of process thinking on the practices of design, their fields of operation, and their productions? And, how can the thematising of process contribute to the design of the constructed environment, as well as reconfigure the practices of design? This thematising of process is argued to involve a necessary address to the constitutive and interrelated characteristics of process: space/time, movement, change, form and matter. Such an address is also seen to problematise the status of the object, the paradigms of representation, the modes of creation, the economies of exchange, and the structures of community, and to offer a modality of practice which would re-imagine the forms of social exchange to offer an ethical alternative to the tyranny of supply and demand, and thereby reconfigure the potential for dwelling. Making an overview of the discourses and practices engaging with theories of becoming, this thesis argues that almost all of these re-inscribe statics and that consequently the practice of design seems to drag behind our understanding of the world. Through a meditation on dis/appearance, in which the dynamics of being and becoming and the restless ambiguity of the gap are examined, the work establishes a process vocabulary, and makes clear through a material practice, the domains of process thinking, its inclinations, and the kinds of operations and procedures that flourish there. Foregrounding the fertile character of process practice, the PhD then proceeds to introduce notions of the movement-form, the duration-form, the transformational-form, the geometry of encounter, and to argue for physical form as an in-movement poise. Advocating new modes of approach and of attentiveness, and demonstrating new generative methods, this PhD argues that process thinking is not simply an operational stance, but an ethical position that identifies a field of care, and that consequently the design practices be expanded by taking seriously the relationship between process thinking and place making. Thus, this thesis concludes by advocating a mode of place making which, rather than reproduce planned environments as systems of control, configures place as the discursive contested place of encounter and exchange.
